The right to data portability

You change you online provider and want to retrieve your data?

The right to data portability allows you to receive, free of charge, the data you provided to a controller, in a structured, commonly used and machine-readable format and to transmit those data to another controller without hindrance from the controller to which the personal data have been provided.

The right to data portability applies only if the data processing is:

  • carried out by automated means or
  • based on your consent or on a contract between you and the controller.

Can the data controller reject your request of portability?

Yes, your request may be rejected if it is manifestly unfounded or excessive, or if the controller cannot identify you.
