The CNPD will now be able to bring collective actions in consumer matters

With the entry into force on 25 November 2025 of the law of 20 November 2025 amending, among other things, the Consumer Code, Luxembourg has transposed Directive (EU) 2020/1828 of the European Parliament and of the Council of 25 November 2020 on representative actions for the protection of the collective interests of consumers.

The collective action is now integrated into a new Book 5 of the Consumer Code under Articles L. 511-1 et seq.

This law grants the CNPD, as a qualified entity, the ability to bring a collective action (also known as a group action or class action) in order to request a cessation or prohibition measure, a redress measure, or both, in cases where the interests of several consumers are harmed by one or more professionals who fail to comply with the obligations laid down by the GDPR.
